Last updated: 15 January 2026

These Terms & Conditions (“Terms”) apply to your use of our website and the purchase of products and services from The Food Farm (“we”, “us”, “our”), including online orders, subscriptions, wholesale supply, farm gate/pick-up, and our onsite honesty shop.

If you have questions about these Terms, contact us at info@thefoodfarm.com.au or 0406 360 588.

1. Acceptance of these Terms

By accessing or using our website or placing an order with us (online or otherwise), you agree to be bound by these Terms.

We may update these Terms from time to time by publishing an updated version on our website. The version in force at the time you place your order will apply to that order.

2. Eligibility

You must be legally able to enter into a binding contract to place an order. If you are under 18 years old, a parent or guardian must place the order on your behalf.

3. Privacy

Our collection and use of personal information is governed by our Privacy Policy (available on our website), which forms part of these Terms.

4. Products and information

We sell food products including meat, poultry, beef and related goods. Because our products are agricultural and perishable in nature:

  • product appearance may vary (e.g., colour, fat-to-lean ratio, cut shape)

  • some items may have natural variation in size/weight

  • product images are for illustration only and may not exactly match the item you receive

  • where an item is sold by weight, the final price is based on the labelled weight/price on the pack (as applicable)

5. Website information

While we take reasonable care to ensure information on our website is accurate and up to date, we do not guarantee that all content will always be current, complete, or error-free.

To the extent permitted by law:

  • the website is provided on an “as is” and “as available” basis; and

  • we do not guarantee uninterrupted access, availability, or freedom from technical errors.

This clause does not limit your rights under the Australian Consumer Law.

6. Accounts

You may browse and purchase without creating an account (guest checkout is available). If you create an account, you are responsible for:

  • keeping your login details secure

  • all activity that occurs under your account

  • ensuring your contact and delivery details are accurate and up to date

We may suspend or restrict accounts where we reasonably believe there has been misuse, fraud, or a breach of these Terms.

7. Website use

You may use our website for lawful purposes only and in accordance with these Terms.

You must not:

  • use the website in any way that breaches any applicable law or regulation;

  • misuse, disrupt, interfere with, or attempt to gain unauthorised access to the website, servers, or systems;

  • use automated systems (including bots, scraping tools, or data-mining tools) to access or extract data from the website without our prior written consent;

  • use the website for unsolicited commercial communications, spam, or unauthorised advertising;

  • frame, mirror, or link to our website in a way that misrepresents our relationship or suggests endorsement without permission.

We may suspend or restrict access to the website (including accounts, where applicable) where we reasonably believe there has been misuse, unlawful activity, or a breach of these Terms.

8. Prices and GST

  • All prices are in Australian Dollars (AUD) and inclusive of GST, unless stated otherwise.

  • Prices may change at any time. The price charged will be the price shown at checkout at the time your order is placed (subject to correction of genuine errors).

9. Minimum order value

The minimum online order value is $50 (AUD).

10. Orders, stock and substitutions

10.1 Order acceptance

All orders are subject to acceptance by us. We may refuse, cancel, or limit orders in our reasonable discretion, including where we believe there is suspected fraud, pricing errors, stock limitations, or logistical constraints.

10.2 Out-of-stock items and substitutions

If an item becomes unavailable, we may (in our discretion):

  • substitute with an equivalent product (and include a note in the box), and/or

  • refund the unavailable item to your original payment method

Substitution decisions may depend on availability and product type.

11. Payments

We accept payment through PayPal, Shopify Payments, and cash/in-person where applicable (e.g., onsite purchases).

Online card payments are processed securely by third-party payment providers. We do not store full credit/debit card details.

12. Delivery (Australia-wide)

12.1 Delivery availability and timeframes

We ship to locations across Australia, subject to courier availability and service coverage. Delivery timeframes vary by region and are estimates only.

12.2 Delivery fees

  • $25 delivery fee applies for orders under $250

  • Free delivery applies for orders $250 and over
(Unless otherwise stated at checkout or for special promotions/remote surcharges where applicable.)

12.3 Authority to leave

All deliveries are madewithout signature. By placing an order, you acknowledge and agree that deliveries will be left at your nominated address without signature.

12.4 Insulated packaging and food handling

All orders are transported using refrigerated courier services to maintain appropriate temperature control during transit. Products are only exposed to ambient conditions at the time of delivery.

Once delivery has occurred, responsibility for the products transfers to you. You are responsible for promptly retrieving and storing all items in accordance with safe food handling practices (including refrigeration or freezing as appropriate).

While our packaging is designed to assist with short-term temperature retention, product quality and safety may be affected if items are left unattended for an extended period after delivery.

12.5 Late deliveries

Delivery times depend on third-party couriers. While we will do our best to assist, we cannot guarantee delivery by a specific time or date unless expressly agreed in writing.

12.6 Incorrect address details

You are responsible for ensuring your delivery details are correct.

If you need to change delivery details, you must contact us with the correct information by Tuesday 5:00pm (AEST/AEDT) prior to dispatch. If details are not corrected by then, we may be unable to change the shipment and we may not be able to provide a refund.

12.7 Missing, stolen or damaged deliveries

If your order is missing, stolen after delivery, or arrives damaged (including compromised packaging), you must:

  • contact us within 48 hours of delivery, and

  • provide photos and any relevant information (e.g., box condition, label, product condition)

We will investigate and, where appropriate, provide a refund, replacement, or store credit, depending on the circumstances and what is reasonable.

13. Delivery Dates & Scheduling

Our products are prepared at our on-farm butchery and packed fresh to order before dispatch.

We deliver to most areas across Australia, subject to courier availability and service coverage.

Order cut-off and dispatch

Orders placed by 4:00pm on Tuesday are generally scheduled for delivery in the same week, subject to location and courier capacity. Orders placed after this time may be delivered the following week.

Delivery typically occurs within 2–7 days from dispatch, with longer timeframes possible for rural, remote, or interstate locations.

Delivery days and timeframes

Delivery days and schedules vary by region. Deliveries generally occur between 8:00am and 6:00pm, and we cannot guarantee specific delivery times.

Delivery schedules are determined by our courier partners, and delivery dates may vary due to factors outside our control, including location, weather, courier routing, and operational constraints.

Order confirmation and communication

After placing an order, you will receive an order confirmation email containing important information, including delivery communication details. It is your responsibility to review this information and ensure your delivery details are accurate.

Our courier partners will usually provide SMS or email updates, including tracking and confirmation once delivery has been completed.

Delivery instructions and access

Any delivery instructions or special access details must be provided before dispatch. Once an order has been dispatched, delivery instructions generally cannot be changed.

If delivery is to an apartment, business address, or gated property, the courier will deliver to the most accessible and reasonable location (such as a lobby, front entrance, or outside a gate) if access cannot be gained.

Courier drivers are unable to:

  • provide specific delivery times

  • call on approach

  • enter private areas of a property

  • deliver to the rear of a property or unpack goods

Changes, redirection, and unattended deliveries

Orders cannot be redirected or rescheduled within 24 hours of the scheduled delivery date.

14. Fresh and Frozen Shipments

We primarily supply our products fresh (not frozen) wherever possible. However, depending on delivery location, transit time, customer request, or other logistical considerations, products may be supplied frozen in order to reduce food safety and quality risks.

Without limitation:

  • Products are generally sent fresh, unless:

    • delivery is to remote or extended-transit locations where transit times may be longer;

    • freezing is necessary to preserve product quality and safety; or

    • you have requested frozen delivery at the time of ordering or prior to dispatch.

  • Where products are supplied frozen, they are fully frozen at our farm prior to dispatch.

  • All shipments are transported using refrigerated courier services

  • While products supplied frozen are dispatched in a frozen state and transported under refrigeration, we cannot guarantee that frozen products will remain fully frozen for the entirety of transit. Partial or complete thawing may occur due to factors outside our control, including transit duration, external conditions, and courier handling.

  • Products that arrive partially thawed but cold on receipt may still be safe for consumption if handled and stored correctly upon delivery. You are responsible for assessing suitability for refreezing or immediate use based on your circumstances.

  • Once delivery has occurred, risk and responsibility for storage and handling transfer to you, including prompt refrigeration or freezing as appropriate.

To the extent permitted by law, variations in product state (fresh, partially thawed, or frozen) during delivery that occur despite refrigerated transport and reasonable handling do not constitute a fault where products remain fit for consumption in accordance with food safety standards.

18. Refunds, replacements and Australian Consumer Law

Nothing in these Terms limits your rights under the Australian Consumer Law (ACL).

Because many of our products are perishable, change-of-mind returns are generally not available. However, where products are faulty, unsafe, not as described, or otherwise fail to meet consumer guarantees, you may be entitled to a remedy.

Where appropriate (and after investigation), we may offer a refund, replacement, or store credit.

To request a remedy, you must:

  • contact us within 48 hours of delivery or pickup, and

  • provide photos/evidence where reasonably requested

19. Limitation of liability

To the extent permitted by law and subject always to your rights under the Australian Consumer Law:

  • our total liability arising out of or in connection with an order, the website, or these Terms is limited to the amount paid by you for the relevant product or service; and

  • we are not liable for indirect, incidental, or consequential loss, including loss of profit or opportunity.

Nothing in these Terms excludes or limits any consumer guarantees or remedies that cannot be excluded under law.

20. Indemnity

You agree to indemnify and hold harmless The Food Farm from and against any loss, damage, liability, cost, or expense (including reasonable legal costs) arising out of or in connection with:

  • your breach of these Terms;

  • your misuse of the website; or

  • any unlawful, misleading, or inappropriate content you submit (including reviews or comments).

This indemnity applies to the extent permitted by law.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.

22. Dispute resolution

If a dispute arises in connection with these Terms, either party may give written notice outlining the nature of the dispute and the desired outcome.

The parties will use reasonable efforts to resolve the dispute in good faith through discussion or negotiation before commencing court proceedings, unless urgent relief is required.

Nothing in this clause limits your rights under the Australian Consumer Law.
